Grieving Aunt enters my office.

Her sister passed away from cancer and left a 10-year-old daughter.

The sister left her entire estate to the Aunt (also named as guardian), so she could take care of her niece.

Mother didn’t know Aunt was struggling financially and was swamped with debt.

Aunt’s creditors force her into bankruptcy shortly after her sister’s passing.

All of the inheritance is now going to Aunt’s creditors.

The daughter is left with nothing. Her guardian has no assets and is in bankruptcy.

Yes, and we have probated many estates with only a copy of the Will; however, it adds additional legal and evidentiary hurdles, including rebutting the presumption that the Will was revoked by the Testator.

Lesson:

Always ensure that your original Will is properly preserved in a document safe or other similar manner and that someone, beyond you and your spouse, knows how to access it without involving a court or relying on a copy.
