Roll-over trucking accidents are commonly caused by negligent or grossly negligent conduct of a truck driver or trucking carrier, including due to drunk driving, drugged driving, fatigued driving, improper loading of cargo, mechanical failures, speeding, improper turns/aggressive turns, and other reckless or careless conduct. Trucking companies are liable for their drivers under the doctrine of respondent superior. This common law, or judge-made law, is derived from the “master-servant” relationship of English common law. Federal regulations prohibit truck drivers and trucking companies from operating a commercial vehicle that is “unsafe.” Unsafe vehicles are those that are likely to cause an accident or a breakdown of a vehicle. Any truck that is operating while unsafe and causes an accident could result in liability for the trucking company—even if the unsafe condition is discovered while doing a delivery.

A disabled truck is a dangerous truck. This is why federal regulations require all disabled trucks to immediately turn on their hazard flashers and within 10 minutes place warning signs 10 feet and 100 feet behind the truck, and 100 feet in front of the truck. If you hit a disabled truck without flashers on or warning signs, it could be the trucker’s fault—not yours!

Truck drivers and other motorists who have a BAC under the legal limit (.08 for passenger drivers/.04 for commercial drivers) can still be found liable for a drunk driving accident.
