New York Divorce Laws Just Got a Major Upgrade, effective as of March 1, 2026.
New York has implemented sweeping changes to modernize its divorce and separation process. Spouses can now obtain a legal separation without assigning blame, thanks to the State's newly introduced no-fault separation option.
Additionally, the required waiting period to convert a legal separation into a final divorce has been cut in half, from 12 months down to just 6 months.
The landmark legislation also raises financial caps tied to inflation: the child support income cap has jumped to $193,000, and the spousal maintenance cap is now $241,000.
These changes speed up timelines for couples moving forward and immediately affect support calculations for ongoing and new family law cases statewide.
