I’m proud to announce the appointment of “Eagle” as my new Director of Smiles.

Eagle is a 10 week old English Bulldog born on Superbowl Sunday. He will be in the office everyday bringing joy and comfort to all my clients. His first project at his new position will be to make a few fun videos as he learns about the law and lawyer life.

Let me start off by saying driving while intoxicated is illegal, dangerous and a terrible idea. Have a designated driver, get an Uber or stay the night and drive home safely the next day.

That being said, know your rights.

When pulled over …
- you DO have to provide your license and registration to the officer AND you DO have to exit the vehicle when requested BUT …

- you DO NOT have to answer any questions of the officer including where you are coming from or whether you had anything to drink;
- you DO NOT have to perform field sobriety tests;
- you DO NOT have to take the portable breathalyzer; and
- you DO NOT have to take the breathalyzer at the police station.

When arrested for an OUI remember …
- the officer is watching your every move including your balance when exiting the vehicle;
- you are being recorded visually and audibly by body and cruiser cameras;
- be polite and courteous to the officer;
- remaim calm and do not resist being placed in handcuffs and
- retain an experienced criminal defense attorney to defend you.

First offense OUIs convictions in Massachusetts may result in sentences ranging from 1 year probation up to 2.5 years in jail; fines between $500 - $5000; completion of and payment for the Driver Alcohol Education Class; 45 - 90 day loss of license; an average of a 74% increase in your auto insurance and a minimum $500 license reinstatement fee.
