Legal custody: major decisions affecting your child's best interest, such as educational, medical, and religious decisions.

Physical custody: where the child actually spends their time.

It's possible to share legal custody but not physical custody. Often, it's best for the child if both parents share legal custody and have the right to make and be consulted about major decisions. Sharing legal custody allows both parents to be involved with their child even if shared physical custody isn't possible.

We talk to a lot of parents who ask whether it makes any sense to pay a lawyer to write up a custody order if they're already getting along. Our answer is always: YES! A custody order signed by a judge protects everyone. If something ever happens where you're suddenly not getting along as well, having an order means your children will have consistent time with each parent while the adults address the adult issues.

A custody order while everything is good is like car insurance: you hope to never need it, but if you ever do you'll be grateful to have it!

Sometimes a parent asks to change the custody exchange time or to expand their time; this can happen if there's a special event or if the parent has something unexpected happen at work. You may wonder if you should say yes to these, or if that will somehow hurt your custody case.

We encourage our clients to agree to these changes if it's at all possible! Even beyond how something "makes your case look," all parents need flexibility at some point, and the more willing you are to offer it, the more likely you are to receive it in return. And in general, being flexible is a positive thing to show in court, rather than negative.

In Pennsylvania, you can't just move to a different city with your child without telling the other parent first. Any move which would affect their custody time requires you to follow certain steps. This is true even if you're "only" moving to the next county over. Not following the proper procedure can cause substantial challenges and complications during a time when you're already trying to plan a move.

"Relocation" happens when one parent moves with a child far enough that it makes it substantially more difficult or impossible for the other parent to have the same amount of custody time and involvement. The relocation rules are complex and each case is determined on a case by case basis.
