I’m happy to report that, once again, dads prevail! My client/father was awarded custody by the circuit court and it was upheld by the South Dakota Supreme Court this week. This case also involved the Indian Child Welfare Act. I love when justice prevails. Today is a good day and it’s the reason I’m a law nerd. If you are interested, you can read the attached decision.

Please read this. Then read it again.

Some people say “I’m not going to lie to my children” as a justification for telling them negative or disparaging things about the other parent or divorce issues or whatever. I don’t buy it. There are options. 1) Just keep your mouth shut. 2) You can tell them the “child’s truth” and not the “adult truth”. Keep it simple, non-judgmental and comforting for the child. If you don’t know how to do that call me or refer to number 1 above.

Some days are diamonds.

I received notice this morning that my client won her Supreme Court case. We have been in a hard fought battle and victory is sweet for both of us but especially for her. I am on to the next battle but she gets to be finished with the legal system and she gets the peace of mind that comes when justice prevails.

Part of my job is lecturing and cheerleading, especially young parents who are really trying. This morning I got a text from a young dad who just got physical custody but there have been some recent bumps. The first part of my response reveals too much info to share but this is what I added a few minutes later. We need to encourage young people to work, to make good decisions and to be thankful. Happy Thanksgiving!

Damaged adults too. I’m not suggesting anyone tolerate physical, emotional, sexual or verbal abuse but I think it is wise to take a step back at times and consider where that negative comment or hurtful remark is coming from. We have all been there.
