For criminal defense attorneys, this case is a reminder of why jury selection matters so deeply. Today, the U.S. Supreme Court ruled in favor of Terry Pitchford, a Black man on Mississippiās death row, after finding serious concerns about racial bias in the jury selection process that led to his conviction. Prosecutors struck 4 out of 5 Black prospective jurors, resulting in a jury made up of 11 white jurors and 1 Black juror.
The Constitution guarantees the right to a fair trial and that includes a jury selection process free from racial discrimination. The Supreme Court reaffirmed that courts cannot simply rubber-stamp ārace neutralā explanations without meaningful scrutiny. When bias infects jury selection, public confidence in the justice system suffers.
This decision also echoes the Courtās earlier ruling in the case of Curtis Flowers, another Mississippi prosecution involving allegations of discriminatory jury strikes by the same prosecutor.
