🦉 Short Answer Except for the new definition of “coercive control” and its inclusion in the (related) definition of “domestic violence”, every aspect of the Alec & Lydia Act can—and should—be applied to all current and future litigation.

Here is the first of several promised installments concerning Arizona's Alec & Lydia Act that are meant to address misconceptions (or offer reassurances, or both) about the new law. Patricia Madsen and I anticipated some of these issues in the early drafting of HB 2995; others came up later. Hopefully, the blog installments will answer them all. But we do invite continued questions, and we will add them to our list! :)

“Subsection C of the new Alec & Lydia Act announces: A domestic violence claim shall be established by a preponderance of the evidence. Corroboration from exhibits or witness testimony of another person is not required. We did not script that new language to design a new legal concept.

I recently tried to post an ad here that explained my role with the drafting of the Alec & Lydia Act and offered information that might encourage a reader (especially a domestic violence survivor) to contact our law firm for representation.
