Last week, attorneys Fabian Zazueta and Oscar Fimbres-Ruiz completed a 5-day jury trial in a case involving real estate fraud, breach of contract, quiet title, among many other claims. The firm was successful in defeating nearly all of the Plaintiff’s claims and obtained a judgment on the client’s unjust enrichment claim.

Less than 3% of civil cases in Maricopa County get resolved via a jury trial. That is because jury trials are expensive, emotionally draining, and too risky. Despite the risks, the Zazueta Law attorneys were prepared, focused, and obtained a great result for the client.

In a Memorandum Decision, the Arizona Court of Appeals affirmed the lower court’s dismissal of Plaintiff’s claims in Rodriguez v. Placido, No. 1 CA-CV 23-0357 (Ariz. Ct. App. 2024)

On June 30, 2020, a fire started at Placido’s home and spread to Rodriguez’s home. Rodriguez filed suit alleging negligence and trespass. After three years of litigation, Placido filed a motion for summary judgment alleging, in part, that Rodriguez failed to compute her damages with reasonable certainty and lack of causation. The trial court agreed and dismissed both claims. Huge win for the Zazueta Law client!

Zazueta Law is happy to announce that Kylie Runkle has joined the firm as our newest law clerk!

Kylie is in her second year at Arizona State University Sandra Day O’Connor College of Law and will be graduating in December of 2024. Before law school Kylie graduated from California State University Sacramento in two and a half years with a B.A. in Public Relations and a minor in Philosophy.

During a 4-day jury trial, Attorney Zazueta and paralegal, Amanda Montgomery, obtained a judgment in favor of a Zazueta Law client pursuant to Rule 50, Arizona Rules of Civil Procedure.

Rule 50 states, in part, “[i]f a party has been fully heard on an issue during a jury trial and the court finds that a reasonable jury would not have a legally sufficient evidentiary basis to find for the party on that issue, the court may: (A) resolve the issue against the party; and (B) grant a motion for judgment as a matter of law against the party on a claim . . .” The Plaintiff failed to submit any evidence of damages with a reasonable degree of certainty, warranting the case dismissal.

The court granted Zazueta Law to submit an application for attorney’s fees for all the fees incurred over the past 3 years of litigation!

On July 25, 2023, the Arizona Supreme Court published a decision in favor of two Zazueta Law clients.

The Supreme Court was asked to resolve the conflict between AZ Rule of Appellate Procedure 7(a)(4)(A) and Arizona Revised Statue 12-2108(A)(1). In short, the Supreme Court ruled that a supersedeas bond does include attorney’s fees because the process for determining the amount of a supersedeas bond is a procedural matter within the purview of the judicial branch. Therefore, the statute did not infringe upon any substantive right.
