The Intersection of Bankruptcy and Probate: A Primer “Till Debt or Death Do Us Part”

Description:
Bankruptcy and Probate have many common elements which make probate a suitable area of law to add to your practice. This Primer will touch on basics of probate practice, provide resources for investigation, and give pointers for how your current bankruptcy practice may be affected. The Primer will also address ethics, obligations to interested parties not clients, fiduciary obligations as we outline the estate process from wills and trusts, avoidance of probate, to the probate process in the Superior Court. Discussion will address exemptions, creditor claims, asset collections, notices and mandatory filings, and practice tips. There will be course materials provided.

We reached out the drafters of the pro-creditor elements in this bill, but to date we have not heard if they would accept our suggestions to at least address our issues under Section 524. So, we must keep moving forward in order to respond to this attack on all Arizona homeowners.

Arizonans are shielded from creditors on the first $150K of equity in homes they own and live in, thanks to a special provision in state law.
