Today were speaking about probate and why a will has to go through probate in Arizona. Rilus explained why a will has to go through probate and that a will guarantees that your estate in Arizona will go Probate. What is an estate? Hey everyone welcome to Probate in Arizona. I had the pleasure of speaking with a friend of mine Rilus Dana of Rilus Law he’s a probate and estate planning attorney licensed in the state of Arizona and California.

Today we had a conversation about probate process in Arizona where Rilus answered and explained the question most people have regarding probate. What is Probate in Arizona? Probate is the judicial process where the probate court in Arizona legally authenticates a last will and testament and appoints a personal representative to manage the estate of the person who passed away in Arizona.

In Arizona Probate occurs when someone passes away and they die “intestate” meaning they died without having a valid will or they passed way “testate” meaning they died having a valid a will. If you pass away with or without a will in Arizona in most cases your estate will have to go through probate.

If you pass away without a will in Arizona, your estate will fall under what is known as Arizona’s intestate succession laws and the court will appoint a personal representative to handle the estate based on Arizona law.
