The Supreme Court of Pennsylvania has now affirmed that determination, holding that the Boroughโ€™s โ€œstream protection fee,โ€ assessed against developed properties based on impervious surface area, is properly characterized as a tax and not a fee.

The standards are intended to ensure that large-scale data center projects deliver meaningful economic benefits while addressing concerns related to energy consumption, environmental impacts and community engagement.
