The insurance companies have a "heads I win, tails you lose" mentality. Let me tell you how:

1. If there is minimal damage to the car after a crash, they argue that it is impossible for the Plaintiff to have a serious injury because it is a minor accident. If there is a lot of damage to the vehicle, they will tell you that vehicle damage is not relevant, it's all about what the medical records show.

2. If there are gaps in treatment, they will argue that if the Plaintiff was hurt he would be treating more consistently. If the Plaintiff is very consistent with treatment, they will argue the Plaintiff overtreated to milk the case.

3. If the Plaintiff does keeps working and doing all their life activities and pushes through the pain, they will argue that is proof that the injuries aren't serious. If the Plaintiff stops working and stops doing other activities, they will argue that they are exaggerating their injuries for money.

4. When the Plaintiff does not have any injuries that show up on a diagnostic study, they will argue no injury occurred. When injuries do show up on a diagnostic study, they will argue the injuries are degenerative. When the injuries are clearly acute and they cannot make the degenerative argument, they will argue that the injuries were self limiting and the Plaintiff made a good recovery.

There are many other examples. If you're injured in an accident, hire a good lawyer who can tear these boilerplate arguments to shreds!

I tried a case in the Middle District of Pennsylvania this week in Scranton. My client is a very nice lady who is the assistant superintendent of a school district in upstate New York and required 3 back surgeries after a fall in the Kalahari icy parking lot that they failed to salt.

The defense did not seem to think much of me, my client, or my case. They made an insulting $7,500 offer and insisted on going to trial.

After a week long trial, a unanimous jury returned a verdict of $2,400,000! I got justice for a very nice client who deserves every penny. I absolutely love being a trial lawyer!

I just finished a jury trial in Chester County where my client had his neighbors tree collapse on him. $349,010.64 verdict! No offers were ever made on the case! I fight like hell for my clients!!!!
