Think FMLA retaliation only happens when someone is fired? Think again.

Under the Family and Medical Leave Act, taking protected medical or family leave cannot be used as a negative factor in any workplace decision. Yet retaliation happens often, and the legal deadlines to act are strict.

COMMON SIGNS OF RETALIATION:

● Demotions, pay cuts, or stripped job duties
● Sudden negative performance evaluations or PIPs right after leave
● Attendance write-ups for using approved FMLA time
● Unreasonable work targets that were not adjusted for your absence
● Moves to unfavorable shifts or isolation from key projects

CRUCIAL DEADLINES YOU NEED TO KNOW (especially in Pennsylvania):

● Federal FMLA Claims: You generally have 2 years from the date of retaliation to file a court claim (3 years if the violation was willful). You do not need to file with an agency before going to court.

● PA State Disabilty Claims (PHRA): If your leave was for your own health condition, state disability retaliation laws may also protect you. In Pennsylvania, you must file with the PHRC within 180 days of the action to preserve state rights.

● EEOC Disability Claims: Federal EEOC charges for disability retaliation carry a 300-day deadline in PA.

WRONGFUL TERMINATION FAQS: KNOW YOUR EMPLOYEE RIGHTS

Can an employer fire you without warning? In PA and NJ, yes, if you are an at-will employee, you can be let go at any time without warning. However, you CANNOT be fired for an illegal reason, such as discrimination or retaliation. If you believe your termination was unlawful, you face strict legal deadlines to protect your rights.

How many days do I have to sue?
You have 180 days to file discrimination claims with the PHRC in Pennsylvania or 300 days with the federal EEOC. Contract breaches or public policy violations typically carry a 2- to 4-year statute of limitations.

Can I be fired after an HR complaint?
No. Terminating an employee for making a good faith complaint about workplace harassment or illegal practices is unlawful retaliation.

Can I be fired while on medical or FMLA leave?
No. Under the Family and Medical Leave Act, eligible workers receive 12 weeks of job-protected leave. You cannot be fired or demoted for taking it. However, you can still be let go during leave if it is part of a separate, documented company-wide layoff.
