When the Medical Ma*****na Act (MMA) was passed in Pennsylvania in April of 2016, it gave hundreds of thousands of residents legal access to cannabis to help manage symptoms of qualifying medical conditions, including chronic pain, cancer, multiple sclerosis, and Post-Traumatic Stress Disorder (PTSD). It also prohibited employers from terminating employees who are certified to use medical ma*****na. However, while the law recognizes that patients who meet the requirements can legally use medical ma*****na, it does not give employees a free pass to use ma*****na any time they want, or to show up to work impaired. If you were fired for legal cannabis use, or you have questions about the MMA, it is highly recommended that you contact an experienced employment lawyer as soon as possible. What the PA Medical Ma*****na Act Protects The Pennsylvania MMA provides a number of protections for certified medical ma*****na patients, including the following: Certain [

Key Takeaways: For employers and employees evaluating a 2026 non-compete agreement in Pennsylvania, enforceability depends on the agreement’s purpose, timing, scope, and industry. Pennsylvania courts scrutinize these restraints because they can limit a worker’s ability to earn a living, but properly tailored covenants may still be enforced. Are Non-Competes Enforceable in Pennsylvania? Yes, in some circumstances. Pennsylvania courts recognize non-competes connected to employment when the restriction is reasonably necessary to protect the employer and reasonably limited in time and geography. Legitimate interests can include trade secrets, confidential information, customer goodwill, and specialized training. What Makes a Restrictive Covenant Reasonable? An employer’s “restrictive covenant” in Pennsylvania should never be any broader than the interest it protects. Courts consider factors such as the restriction’s duration and geographic reach, the employee’s duties, access to confidential information, customer relationships, and whether the covenant protects a legitimate business interest rather than ordinary competition. Employers should [

When you are in a job interview, a prospective employer may ask you a range of questions about your education, your experience, and what unique qualities you bring to the position. However, if you are applying for a job in Philadelphia, the person conducting the interview may not ask you how much you made at your previous job. In fact, according to the “Philadelphia Salary History Ban,” it is against the law to ask applicants questions about their past earnings and use that information to pay them less than what they deserve. If an employer asked you to provide information about your salary history during an interview, it is highly recommended that you contact an experienced employment lawyer at your earliest convenience. What Does the Salary History Ordinance Prohibit? The Philadelphia Salary History Ban officially went into effect September 1, 2020. The ordinance is part of the city’s Wage and [
