On June 25, 1938, one signature reshaped the American workplace.
President Franklin D. Roosevelt signed the Fair Labor Standards Act into law, and for the first time federal law set a minimum wage, guaranteed overtime pay, and put real limits on child labor.
Nearly 90 years later, those protections still cover millions of workers. And employers still find ways to cut corners.
If you are clocking out but still working, getting shorted on overtime, or watching your hours disappear, the FLSA may apply to your situation.
Know your rights. The law signed in 1938 was written for you.

Think your boss can hit you with a surprise pay cut?

Not so fast.

A pay cut generally cannot be applied to hours you already worked. In many states, employers must give advance notice before lowering your rate going forward.

If your paycheck suddenly looks different, check your pay stub. A quiet pay cut could be a wage violation, and you may be owed money.

Salaried but picking up hourly shifts? It is more common than you think. An exempt employee may take on extra hourly work without losing exempt status, as long as their primary duty stays exempt work. The catch: the full guaranteed salary still has to be paid.
Mixing pay structures can get complicated fast, and mistakes can cost you.

Clocking in late but working early? Pre-shift work can be pay time. If you perform integral and indispensable job duties before your shift officially starts, that time may be compensable under the FLSA. Handoffs, equipment setup, system checks, and required prep can all count.
If your real workday starts before the clock does, you may be owed for it.

Does leaving the building make your meal break paid time? Usually no, if you are genuinely free from job duties while you are gone. The key question is not where you spend your break, it is whether you were actually relieved of work.
If you are answering calls, monitoring messages, or staying on standby during lunch, that break may need to be paid.

Long walk to the break room? Here is what the law generally says. If you are fully relieved of all duties, travel time during an unpaid meal break is usually not compensable under the FLSA. But the details matter, and state laws may offer greater protections than federal law.
If you are not truly free during your break, your meal period may not be as "unpaid" as your employer thinks.

Just a few minutes off the clock?
It still counts. Small amounts of regular off-the-clock work can add up fast, and that time may need to be paid. Regular work time is not automatically treated as "de minimis" just because it is short.
Logging in early, prepping before your shift, or finishing tasks after you clock out could all be compensable.

Does your employer round your clock-in and clock-out times? Rounding is not automatically illegal, but it may violate the FLSA when it consistently erases actual time you worked. A lawful rounding policy has to be neutral over time, meaning it cannot always tip in the employer's favor.
If your hours keep getting shaved down, it may be worth a closer look.
