A Criminal Defense Lawyer’s Legal Brief(s),

Leaving the courthouse, I was asked if I liked watermelon by a lawyer that I shared space with. He was standing next to his client. I said “of course.” So the lawyer told his client to bring three of them. Back at the office, there were three watermelons on the back table. The lawyer told me his client was a farmer that owed him $3,000.00, that he would never see. He said to enjoy the $1,000.00 watermelon.

New Scam- A client’s mother got a call from a bail bondsman this morning saying that bond was set at $2,500.00 and to give them her credit card over the phone. However, there was no bond pending Client’s first appearance at 1:30 p.m. Bond was set then, and not at $2,500.00. Be aware, call a criminal defense lawyer.

Spring break, Red Solo cup and looking like underage drinking tip- Drinking out of an opaque (red Solo) cup is not grounds for law enforcement to detain a person. Lugo v. State, (Fla. 5th DCA 2004). Likewise, a defendant's stop and detention may not be based upon their youthful appearance, Baggett v. State, (Fla. 1st DCA 1988).
