What To Do After A Car Accident in Florida

A car accident can happen in seconds — but what you do in the hours and days that follow can make or break your case. Here's what every Florida driver needs to know.

🚨 1. Call the Police
Always call law enforcement, even for minor accidents. Injuries are often not apparent at the scene but worsen significantly in the days that follow. A police report documents what happened and helps establish fault.

📸 2. Document Everything
Photograph both vehicles, any visible injuries, and the other driver's license and insurance card. Get the names and phone numbers of all drivers and witnesses.

🏥 3. See a Doctor — Within 14 Days
This is critical: Florida law requires you to receive medical treatment within 14 days of your accident or you permanently lose access to your $10,000 in PIP (no-fault) insurance benefits. Don't wait.

💡 4. Know Your PIP Benefits
Every Florida car insurance policy must include at least $10,000 in Personal Injury Protection (PIP) or "no-fault" coverage. PIP pays 80% of your medical bills and 60% of lost wages — and it's always primary over your health insurance unless you were injured on the job.

🎙️ 5. Don't Give a Recorded Statement

This recent article in the Pensacola News Journal demonstrates the importance of having uninsured motorist insurance coverage, or "UM" coverage, in your automobile insurance policies. Even if the accident does not involve a hit-in-run driver and the negligent driver can be identified, Florida is one of only a few states in the country that do not require the drivers and owners of vehicles to carry any liability insurance coverage to pay for your injuries or damages if they were to injure you or one of your family members in an auto accident. The best way to protect yourself from an uninsured motorist is by making sure your own automobile insurance policy has UM coverage. UM insurance is an optional insurance that many drivers regrettably fail to purchase simply because it is not required by law. However, while other insurance coverages provide compensation to others for injuries you cause them in an accident, UM insurance is the only automobile insurance coverage available to compensate you or your family members for damages in the unfortunate event you or a member of your family are the victim of an uninsured driver. UM insurance covers you not only for injuries and damages caused by a driver who fails to carry automobile insurance, but it also helps protect you in the event your injuries and damages caused by a negligent driver exceed the driver's bodily injury liability insurance limits.
