Going through a divorce? Your estate plan may need to wait on one thing first. 🏠📄
You can only give away property you actually own. That sounds simple. But after a divorce, it isn't always clear.
If you and your ex owned a home or other asset together, your marital settlement agreement spells out who gets what. Sometimes that agreement says certain steps must happen before the property is fully yours.
If those steps never get done, you could plan to leave an asset to your kids or loved ones, only to find out it was never fully transferred to you.
My advice? Don't wait. Not 10 years. Not even one year. Follow through on your marital agreement right away. Then, when you sit down to create your estate plan, you can leave your property to whoever you choose, with no surprises.
