Grandparent's Rights:

I am often asked about what rights grandparents have to visitation with their grandchildren in Alabama. Alabama law does provide a means for grandparents to petition for visitation with their grandchildren, but they must meet certain criteria and be able to prove that they are entitled to such visitation, especially if the childrenโ€™s parents do not wish them to have such visitation.

In order to petition for grandparent visitation, a person must be a grandparent, meaning they must be a parent of a parent, whether that relationship is created biologically or by adoption. A grandparent must file a request in court for visitation rights. They can file a new case requesting these rights, or they can file in a case already pending in court, including in a divorce action or a non-divorce custody action involving their grandchildโ€™s parent or parents. You can also request that the court award you temporary visitation while your petition is pending.

In order to prevail on a request for grandparent visitation rights, the grandparent must present clear and convincing evidence that visitation is in the grandchildโ€™s best interest. This evidence must be strong enough to overcome the constitutional right of fit parents to deny or limit such visitation. Alabama law provides that this strong evidence must show that the grandparent has established a significant and viable relationship with the grandchild, and that the requested visitation is, again, in the best interest of the grandchild, and that to disallow grandparent visitation would cause harm to the childโ€™s emotional, physical, or mental well-being. Additionally, the grandparent is required to prove by clear and convincing evidence that at least one of the following circumstances exist:

1) the child resided with the grandparent for at least six (6) consecutive months with or without a parent present within the three (3) years prior to filing the petition;

2) the grandparent was the caregiver to the child on a regular basis for at least six (6) consecutive months within the three (3) years prior to filing the petition, or

3) the grandparent had frequent or regular contact with the child for at least twelve (12) consecutive months that resulted in a strong and meaningful relationship with the child within the three (3) years prior to filing petition.

APPEALS
I have been doing appeals for 20 years. Not all attorneys do appeals. In appealing a case, I research and write about errors that the judge or lawyers made before, during, or after a trial in a lower court. I present these errors to the appellate courts in a brief for their review. The appeals courts can then determine if the law and rules were followed in the case. If the laws were not followed, the appellate courts will reverse the decision or send the case back to the lower court for further action.
