Tener la tarjeta de residencia no garantiza que CBP lo deje reingresar.

Hoy el riesgo en la frontera depende mucho de su estatus migratorio. Un residente permanente legal que pasa más de 180 días fuera del país puede ver su viaje interpretado como abandono de residencia, y cualquier persona con un asunto penal pendiente enfrenta interrogatorios duros al regresar. Quienes tienen DACA o TPS viajan con un permiso anticipado de viaje que puede cancelarse mientras ya están en el extranjero. Y quien todavía espera su solicitud de residencia permanente es considerado fuera de estatus hasta la aprobación — lo que convierte los aeropuertos en un riesgo real, incluso en vuelos nacionales.

Having a green card in your pocket doesn't guarantee CBP lets you back in.

Risk at the border now depends heavily on your status. Permanent residents gone more than 180 days can have the trip read as abandoning residency, and anyone with a pending criminal matter faces hard questioning on return. DACA and TPS holders travel on pre-approved authorization that can be cancelled while they're already abroad. Applicants still waiting on a green card are treated as out of status until it's approved — which makes airports a real risk even for domestic flights.

Valid paperwork helps. It doesn't override an officer's discretion.

Starting September 18, an immigration officer reviewing your green card case can weigh a lot more than your income.

The new public charge rules let officers consider age, health, family situation, education, job skills, and a wider list of benefits — SNAP, WIC, Medicaid, subsidized housing — but only for benefits received on or after that date. Anything received before it generally falls under the older, narrower standard.

Consulates are also retraining staff on the new policy, so some scheduled immigrant visa interviews may get pushed.

An Affidavit of Support still matters. It just no longer guarantees approval.
