Tonight’s debate was embarrassing and clearly Trump showed himself to be who he is: He was rude, inarticulate and vehemently moronic. Now, unfortunately Vice President Biden allowed Trump to get under his skin and was not at his best. But, this isn’t about Trump or Vice President Biden. This is about America and what we want for this country and what we hope to give our children. When Trump was asked specifically will he condemned white supremacists and groups that promote racial division Trump REFUSED to condemn them. This, to me, speaks volumes. We, as Latinos, must stand against Trump and vote BIden/Harris.

BREAKING NEWS ON DACA!! Trump and his Administration has made it clear that they are going to violate the Supreme Court’s decision by not permitting New DACA Applications. See below:

U.S. Citizenship and Immigration Services today provided guidance on how it will implement Acting Secretary of Homeland Security Chad Wolf’s July 28 memorandum regarding the Deferred Action for Childhood Arrivals (DACA) policy.

Under USCIS’ implementing guidance, we will reject all initial DACA requests from aliens who have never previously received DACA and return all fees. The rejections will be without prejudice, meaning aliens will be able to reapply should USCIS begin accepting new requests in the future from aliens who never before received DACA. USCIS will continue to accept requests from aliens who had been granted DACA at any time in the past and will also accept requests for advance parole that are properly submitted to the address specified on the Direct Filing Addresses for Form I-131 webpage.

For approvable DACA renewal requests, USCIS will limit grants of deferred action and employment authorization under DACA to no more than one year, but will not rescind any currently valid two-year grants of DACA or associated employment authorization documents (EADs), unless USCIS terminates an alien’s DACA for failure to continue to meet the DACA criteria (see 2012 Memorandum), including failure to warrant a favorable exercise of prosecutorial discretion. USCIS will replace two-year EADs that are lost, stolen or damaged with the same facial two-year validity period assuming the EAD replacement application is otherwise approvable.

USCIS will generally reject requests received more than 150 days before the current grant of DACA expires. DACA recipients should file their renewal request between 150 and 120 days before their current grant of DACA expires.

USCIS will only grant advance parole for travel outside the United States to DACA recipients pursuant to the new guidance, which provides for a determination that parole of the alien is for urgent humanitarian reasons or significant public benefit in keeping with the governing statute. The agency will not rescind any previously granted advance parole documents unless there is another legal reason to do so. However, as has always been the case, parole into the United States is not guaranteed. In all cases, aliens are still subject to immigration inspection at a port-of-entry to determine whether they are eligible to come into the United States.

The determination whether to grant advance parole to an alien is entirely within the discretion of USCIS and must be made on a case-by-case basis. USCIS will review all the factors presented in individual cases before determining whether to approve advance parole for a DACA recipient based on the new guidance. Some examples of circumstances that may warrant approval include, but are not limited to, situations such as:

Travel to support the national security interests of the United States;
Travel to support U.S. federal law enforcement interests;
Travel to obtain life-sustaining medical treatment that is not otherwise available.

Joe Biden vows to end 'this season of darkness for America'

I watched FOX News after Joe Biden accepted the Democratic Nomination for President to get a sense of what the zombie Republicans were saying regarding Joe Biden’s speech. I happened to watch tidbits of the Laura Ingraham show where she was featuring Donald Trump Jr. And she made a statement which is absolutely true: Americans are not stupid. CHEATER, [email protected] That’s what Trump is! This President is trying to undermine a government institution by preventing the United States postal office from being able to count mail in votes. Although she came into the scene after I had been ordered deported, Ms. CORRALES WAS ABLE TO UNDO all of that and in the end win my case. With so many hurtles, complications, and stubborness on behalf of DHS, she was still able to get me good results. Even though I was not so happy with conviction, at least my case was terminated and I am now home, free to work and be with my son. I thank God either way and Ms. Corrales. She is very direct and blunt when she explains things so make sure you pay attention and ask all that needs to be asked so that you understand what is going on. She did go and do above and beyond what she was paid to do and to help me be released from detention and for that I will always be thankful for.

Trump Administration Fee Hike an Attack on Legal Immigration, Says Advocate

For those interested in becoming a United States citizen, it is important for you to speak to an attorney to make certain that there were not going to be any legal issues. Applying for US citizenship is not just filling out an application. Also, the fees to become a naturalized citizen are going up astronomically. The Trump Administration is making it financially difficult so that people don’t become US citizens. But if you’re a lawful permanent resident, it’s no longer enough to be just that you must, if you can, become a US citizen.

I specialize in complex your citizenship cases so If you need a consultation please feel free to contact me or any licensed attorney.

If anyone has seen Immigrant Nation on Netflix what is the common theme? ICE will pound on your doort and never will say they are from ICE. Instead, ICE will pretend and say they are “police.” Well, that’s bullsh*t and that’s wrong and that’s a misrepresentation. I don’t care how loud ICE agents are pounding, let them break down the door...but if you let them in then ICE doesn’t have to produce a warrant just remember that. Do not let ICE in unless they have a valid sign the warrant to be able to search your promises.

BREAKING NEWS:

It took a while to review this memo BUT DHS issued a new MEMO on DACA. It's an 8 page document that has taken me sometime to review.

Here is the extent of what the Memo states:

Accordingly, effective immediately, DHS shall:

Reject all initial DACA requests and associated applications for Employment Authorization Documents, and refund all associated fees, without prejudice to re-filing such requests should DHS determine to begin accepting initial requests again in the future.

Adjudicate all pending and future properly submitted DACA renewal requests and associated applications for Employment Authorization Documents from current beneficiaries.

Limit the period of any deferred action granted pursuant to the DACA policy after the issuance of this memorandum (and thereby limit the period of any associated work authorization) to one year.

Refrain from terminating any grants of previously issued deferred action or revoking any Employment Authorization Documents based solely on the directives in this memorandum for the remaining duration of their validity periods.

Prior to July 24, DHS’s treatment of advance parole requests from DACA recipients varied. Many were rejected, while some were accepted and receipted. To the extent any rejected requestor believes exceptional circumstances support his or her request, he or she may now renew the request for advance parole, and it will be adjudicated on set forth on this memorandum.

This is all very complicated so please I suggest you contact a licensed attorney if you have DACA or if you’re thinking of applying for DACA.

Trump administration to reject new applications for 'Dreamer' immigrant program

NEWS ALERT:

This afternoon the Trump Administration made the decision to completely put this country in a Constitutional crisis by stating that they will not except any new DACA applications despite the Supreme Court’s decision on June 18. The Trump Administration announced that it will to review the Supreme Court’s decision and that the review is going to take 100 days...of course, after after the elections. Trump also said that he will limit renewal of DACA employment authorization to one year and not two.

For those that I have helped become US citizens there is no time in history like now that your vote is CRUCIAL. .. you must vote. In my opinion, this president has brought this country to its knees. He CANNOT LEAD on a national level. We have been suffering through this coronavirus pandemic without any leadership from the Trump Administration and now he is sticking his middle to the Supreme Court of the United States ( the greatest court and the highest court of this land) and saying we’re not gonna follow your orders.

We cannot and must not tolerate that kind of behavior.

News Alert:

Los Angeles Immigration Court is closed through and including August 7, 2020. The immigration courts are closed for non-detained cases. Those who have detained cases in Adelanto Detention Center still have court hearings. The reason for another extension of the closure is due to the increasing number of positive Covid patients. It’s imperative if we’re ever going to fight off this virus to wear masks. What’s the big deal? I urge all of you to wear your mask and to wash your hands. I owe you and everyone in my community the duty to be socially responsible as you owe me a duty to be socially responsible. Social responsibility includes wearing your mask.
