Today, my client, Mr. Torres, became a United States citizen. We arrived at the San Bernardino Office for USCIS at 6:30 am for his interview. The USCIS Officer was professional and reasonable in how he conducted the interview. Understandably, my client was very nervous. He missed the first question asked of him during the civics test but then he answered every other question correctly.

I know that families are desperate, people are desperate. But the solution isn’t to send your defenseless children, who cannot protect themselves, to travel alone to the United States by themselves. It’s also immoral and illegal to give your child to a smuggler in order for the child to be brought to the United States. That is not the solution!! My God, these are babies. Citizens of Honduras, Guatemala, El Salvador please do not do this to your children; your children depend on you; they need to feel protected. This is not a solution to your immigration situation.

This morning my Office was happy to have argued the case of Ms. Rancharan. I filed a motion to vacate Ms. Rancharan’s felony welfare conviction. The district attorney’s office came in with legal arguments opposing the motion but after hearing from me and reviewing my motion, the Superior Court granted and found that Ms. Rancharan was not properly advised of the immigration consequences and therefore vacated her conviction on legal grounds. This is not an expungement..this so much more.

Now, Ms. Rancharan will not be subject to deportation and she can now apply for citizenship. Great day!

DHS Secretary Statement on the 2019 Public Charge Rule

Today, DHS Secretary Alejandro N. Mayorkas announced that the government will no longer defend the 2019 public charge rule as doing so is neither in the public interest nor an efficient use of limited government resources.

“The 2019 public charge rule was not in keeping with our nation’s values. It penalized those who access health benefits and other government services available to them,” said Secretary of Homeland Security Alejandro N. Mayorkas. “Consistent with the President’s vision, we will continue to implement reforms that improve our legal immigration system.”

President Biden’s Executive Order on Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans called for an immediate review of agency actions on public charge inadmissibility and deportability. DHS’s review, in consultation with the Departments of Justice and State and the federal benefits-granting agencies, is ongoing.

As discussed in DHS’s litigation statement, and consistent with the government’s decision not to defend the rule, the Department of Justice is no longer pursuing appellate review of judicial decisions invalidating or enjoining enforcement of the 2019 public charge rule. Today, the Department of Justice dismissed its pending appeals in the Supreme Court and Seventh Circuit, and is in the process of doing so in the Fourth Circuit. Following the Seventh Circuit dismissal this afternoon, the final judgment from the Northern District of Illinois, which vacated the 2019 public charge rule, went into effect. As a result, the 1999 interim field guidance on the public charge inadmissibility provision (i.e., the policy that was in place before the 2019 public charg

BREAKING: Justices Say Immigrants Must Prove Eligibility For Protection.

The U.S. Supreme Court on Thursday held that immigrants with certain convictions must prove their eligibility for deportation relief, even when the record surrounding the conviction is unclear.

I had to analyze the case (Pereida v Wilson) before posting about its effect. The case involved a non-citizen individual who was placed in proceedings to be removed. While in removal proceedings, Mr. Pereida applied for cancellation of removal. To be eligible for cancellation of removal, Mr. Pereida had to demonstrate that: 1: he had been residing in the US for 10 years; 2: that he had a lawful permanent resident or US citizen child spouse or parent that would suffer extreme hardship if he was deported and 3: he had to show he was a person of good moral character. However, while in removal proceedings, Mr. Pereida was convicted of some crimes. The problem was the court were not clear as to which crimes he was convicted of.

The Supreme Court held that Mr. Pereida has to proof that he was eligible for immigration relief and if he cannot establish that he wasn’t convicted of a crime involving moral turpitude then he was not eligible for cancellation of removal.

What I discern from the Supreme Court’s opinion is that it if you have a criminal conviction, the records have to show that the crime is not a disqualifying crime. If you find yourself charged with a criminal offense and you have to go to criminal court, I urge you to get a criminal defense attorney who understands immigration law so that that attorney makes sure that the record is clear. A good criminal defense attorney will try and avoid stipulating to a factual basis or to a police report if it’s possible.

White House announces sweeping immigration bill

Breakilng News!!

Good morning community. I hope everyone’s doing well. Today, the Biden Administration introduced a bill that would overhaul the immigration system and provide a pathway for those who are here unlawfully and for Dreamers to become lawful permanent residents first and then to become US citizens if they are legally eligible. This is a great first step towards immigration reform. But, the bill does face opposition and it will be an uphill battle with strong opposition from people like Senator Ted Cruz, Senator Marco Rubio and all the other conservatives who continue to believe in Trump’s policies.

What can we do as a community? Pray that our Nations leaders will be guided by wisdom and courage.

Breaking News!!

Good morning community. Yesterday, February 2, 2021, there was so much immigration news. Let me summarize;

First, the Department of Homeland Security (DHS) has its first Latino Secretary. Alejandro Mayorkas, a Cuban immigrant, was confirmed as the Secretary of DHS. Under the Obama Administration, Secretary Mayorkas was the Director of USCIS and so has much familiarity with the agency and the goals it should encompass. THIS is a GOOD CHANGE!!

Second, as part of an Executive Order to remove barriers to the legal immigration system, President Biden directed an immediate review of the Trump-era public charge regulations. The announcement came just weeks after 500 nonprofit organizations affiliated with the Protecting Immigrant Families coalition sent a letter urging the President to act quickly in dismantling the wealth test created by the last Administration. This is an important first step by the Biden administration.

What does the Executive Order do? Well, it ordered three agencies: DHS, the Department of State and the Department of Justice to review Trump”s Public Charge rule and to take action to address the policies’ affect on our immigration system within 60 days.

These are first great steps!!
