Digital Access Records and Video Evidence Defeat a Shifting Accident Claim

WINNING RESULTS: Board Panel Imposes Permanent Indemnity Disqualification After Surveillance Appeal

The claimant testified that exercise was limited to physical-therapy restrictions and reported to treating providers and the independent medical examiner that he could not work out and had difficulty walking. Surveillance showed a markedly different level of activity: the claimant walked several city blocks to a gym, loaded multiple 45-pound plates onto a leg-press machine, and performed deadlifts and chest presses well beyond the weight limits described in testimony.

Lois Law Firm Associate Chris Xyloportas and Paralegal Chrystalla Karamanis disclosed the surveillance, raised Workers’ Compensation Law § 114-a, and developed the fraud record.

The claimant filed multiple labor market attachment submissions, but Lois Law Firm Associate Bradley Haymes and Paralegal Gianna Sorrentino demonstrated that the overall effort was not timely, diligent, persistent, or tailored to the claimant’s abilities. Approximately two dozen applications over a six-month period did not establish a sustained good-faith search.

WINNING RESULTS: Prior Medical Records and Surveillance Support Permanent Indemnity Disqualification

The claimant denied prior treatment involving the right leg and psychological conditions and failed to disclose a significant motor vehicle accident on the employee claim form and to treating providers. Records from that earlier accident later showed treatment to the same body part and psychological conditions at issue in the workers’ compensation claim, including treatment by a provider who also participated in the later claim.

Lois Law Firm Associate Ryan Wallace and Paralegal Samantha Barker paired that medical-history investigation with surveillance that contradicted the claimant’s reported need for a cane and claimed inability to drive.
