Thinking About Putting Your Florida Homestead in an LLC? Think Again.
An LLC can offer certain liability protections, but transferring your homesteaded property into an LLC can have an unexpected property-tax consequence.
In Florida, transferring a homesteaded property to or from an LLC may be considered a change in ownership for property-tax purposes, which can cause your existing Save Our Homes assessment cap to be removed and your assessed value to reset toward market value. That could mean a significantly higher property-tax bill the following year.
And if you've already made the transfer this year, the Pinellas County Property Appraiser says there may be a way to transfer the property back before year-end to avoid the reset.
Bottom line: Before you transfer your homestead into an LLC, make sure you understand the potential tax consequences. A decision that looks like a simple ownership change could have a very real impact on your tax bill.
