An employer in Riverside, California, is facing liability after a federal investigation into their alleged wage and hour violations. The DOL found that the employer had paid employees straight-time for hours worked over 40 each week. The federal investigators recovered over $200,000 in back wages and additional recordkeeping violations. The DOL also imposed $11,264 in civil penalties.

Employers, keep in mind that your company must (1) track overtime accurately and exactly (no approximations), (2) ensure accurate records to avoid unpaid overtime, and (3) avoid any willful misconduct.

Effective January 1, 2026, Senate Bill (SB) 642 strengthens California’s equal pay and pay transparency rules by changing the definition of “pay scale” in job postings and broadening the protections for employees.

SB 642 revises the definition of “pay scale” to mean an estimate of the expected wage range that an employer reasonably expects to pay for the position upon hire. This new law also prohibits an employer from paying employees at wage rates less than the rates paid to employees of another s*x.

Employers, in light of these changes, it is imperative that you review and revise your job-posting templates, pay scales, and compensation practices to ensure compliance with this new law.
