🗞️ In NACBA News: Major Ninth Circuit BAP Victory Clarifies Limits on Private Student Loan Nondischargeability

A significant win was handed down on February 27, 2026, when the United States Bankruptcy Appellate Panel of the Ninth Circuit reversed a bankruptcy court ruling in Pearson v. Nichols, a case addressing whether a private student loan can be partially excepted from discharge under 11 U.S.C. § 523(a)(8)(B).

This victory did not involve federal student loans. It was a case with unique circumstances that resulted in a trial where the plaintiffs attempted to claim a loan was a student loan and thus, the debt could not be discharged in bankruptcy. We fought hard but lost at trial. But we didn’t give up! We appealed and prevailed on all issues. The Ninth Circuit Bankruptcy Appellate Panel reversed the lower court! The entire debt is discharged!
