When you order a ride home, you trust that the company sending the driver has done its homework. The New York Times recently put a hard question on its front page: what happens when that trust is broken — and a survivor decides to fight back?

One of the brave women featured in this national story is our client, a young woman from the Tampa area. Andrew Harris will be the Program Chair and speaking at the Florida Justice Association's 2026 Proposal for Settlement Webinar this Friday, where he will present "Joint Offers and Possible Reform in Light of the Florida Supreme Court's Recent Decision."

Drawing on his recent experience before the Florida Supreme Court, Andrew will discuss the Court's decision impacting joint offers, what it means for practitioners, and the potential for future reform.

The webinar will also feature other experienced appellate and trial attorneys covering the latest case law, insurance-specific considerations, and practical guidance on the role of demanding or offering a judgment.

The Firm is pleased to report another Fourth DCA victory by Grace Streicher in a property insurance case! In Deitz v. Homeowners’ Choice, the appellate court affirmed a jury verdict for our clients after their homeowners’ insurance company wrongfully denied their claim for damage caused by their plumbing system. The insurance company fought for years to avoid paying the claim, but at trial, a jury determined that the claim was covered. Undeterred, the insurance company raised a host of arguments on appeal, trying to get the jury’s verdict reversed.

In addition to providing litigation support in the trial court, Grace successfully defended the appeal, resulting in the appellate court issuing a per curiam affirmance rejecting all of the insurance company’s arguments. Grace is grateful to her trial team of Chris Kellam and Michael Knecht for again turning to her to help their clients retain their victory.

Honored to share a recent victory before the Florida Supreme Court this month - one that mattered deeply to our client, brought needed clarity to Florida law regarding proposals for settlement, and may set the stage for reform.

In a closely divided, rare 4-3 decision, the Court held that a joint proposal for settlement must include an amount for each of the plaintiffs, with no exceptions for unified claims, married parties, or joint property owners. Our client, a small business owner, was relieved of any obligation to pay what would have been hundreds of thousands of dollars in attorneys’ fees.

But here's what makes this decision truly fascinating: in briefing at the Supreme Court, while Andrew urged the Court to follow its precedent and rule for our client, Andrew recognized there could be reform for the future. The entire Court agreed this area of law may change.

The Majority acknowledged the practical difficulties of the rule and wrote that “the appropriate course is to review the rule and, if a change is warranted, amend its text.” And three dissenting justices went even further, calling joint settlement proposals “a trap for the wary and unwary alike” and urging the Court to “correct course.”

Translation: the story isn't over. The Supreme Court and the Legislature may take a fresh look at this in the years ahead.

Andrew has spent his entire career writing, teaching, and helping trial attorneys draft and evaluate these settlement offers. He is widely regarded as Florida's leading authority on this famously vexing subject. This case puts that career’s worth of work to its highest test, and positions Andrew at the center of whatever comes next.
