If you slip and fall at a store or other commercial property in Florida, the business is not automatically responsible for your injuries.

Attorney Jeffrey Vizcaino explains what Florida law requires you to prove.

First and most important, get medical attention if you need it.

Take photos or video of what caused you to fall if you are able to before the area is cleaned. This includes getting photos of the surrounding area.

Report what happened to the store so they can document a record of the accident.

Never assume the store will have surveillance footage of your accident available later. Surveillance video can be overwritten but evidence can be preserved when the right request is sent in.

Even if you left without photos or video, you may still have a claim.

Don’t assume the store will still have surveillance footage when you need it.

After a slip and fall, video evidence may be overwritten within days or weeks depending on the store.

And according to Attorney Jeffrey Vizcaino, the store may not have an obligation to preserve that evidence unless it has been put on legal notice of a potential claim.
