LIFE-CHANGING IMMIGRATION POLICY. The Biden Administration has announced that it will allow certain undocumented immigrants to adjust their status to lawful permanent residents and receive GREEN CARDS.

BACKGROUND: Under the existing law, those who enter the United States illegally without a visa are generally ineligible to adjust their status IN THE U.S. even if they have a U.S. citizen spouse.

NEW POLICY: The new policy resolves the problem for those who have entered the US illegally without a visa. The immigrant may apply for a "parole-in-place" (which serves like a lawful entry document) if 1) he/she has been residing in the US for at least 10 years and 2) is married to a US citizen.

THE APPROVAL of the parole-in-place application will be considered on a case-by-case basis and on a discretionary basis. The applicant's character and any criminal record will be considered. But overall, this measure of parole-in-place is a major initiative which will enable many undocumented immigrants to adjust their status by resolving their unlawful entry into the US. It will promote family unity and the stability of families.

THIS MORNING, we were able to get three clients naturalized and get their citizenships. For some it was a long journey of many years since they came to the United Stated and they had tears in their eyes as they took their oath. I am honored to help them realize the American dream.

EXCITING NEWS on the Immigration Front: Last week, President Biden signed into law the extension of the EB-5 Regional Center Program! This is the job creation program to get a GREEN CARD that expired last year, but now has been extended until September 30, 2027. The program does raise the minimum investment amount from $500,000 to $800,000.

This is great news for foreign investors looking for a green card to live in the US.

UPDATE: The U.S. House passed a bill providing a pathway to legalization for many immigrants. While this is encouraging, this bill has not yet passed the Senate. It is not yet "law." Please send a courteous email to your Senators to vote in favor of the bill so that the President may sign it into law. Here is how to find your senator's contact info.

AS PROMISED, here is the UPDATE, my friends. The upshot: we keep forging ahead to unite families!

Today, the President signed the proclamation. Effective midnight tomorrow (ironically, coinciding with the beginning of Ramadhan), the U.S. will suspend the issuance of IMMIGRANT VISAS. But WAIT: there are exceptions to this suspension.

-First, note that this proclamation applies only to those who are overseas on the effective date of the proclamation. It does NOT apply to those seeking adjustment of status in the U.S.
-Second, it does NOT apply to people who are already lawful permanent residents or who have already been issued immigrant visas.
-Third, it does NOT apply to spouses or children of U.S. citizens.
-Fourth, it does NOT apply to non-immigrant visa applicants.
-Fifth, there are other exceptions as well.

This limited suspension is for 60 days and will be re-evaluated. These are just some of the important points of the proclamation that I wanted to mention to you. For the most part, we are continuing with the immigration applications.

Just want you to know that BRINK AHMED IMMIGRATION is continuing to work. While the Orange County curfew order goes into effect this Thursday, the order allows legal service businesses to remain open. Thus, we will remain open. Also, under the order, people are permitted to travel for legal services. However, for the safety of our clients and our workers, we offer Skype and phone consultations. For those who wish to meet in person, we have secured a separate conference room while practicing sanitation and social distancing guidelines.
