The federal court in the Middle District of Florida granted a writ of habeas corpus and ordered our client’s immediate release after finding that the federal government unlawfully arrested and detained him.
The judge ruled that ICE misapplied federal immigration law, ignored due process, and held our client without a warrant, charges, or lawful authority. The Court made clear that individuals already living in the United States with an active immigration process cannot be subjected to automatic detention without hearings.
The government was stopped from continuing this unlawful practice, and federal prosecutors were ordered to explain why they should not be sanctioned.

Un tribunal federal del Distrito Medio de Florida concedió un recurso de habeas corpus y ordenó la liberación inmediata de nuestro cliente tras determinar que el gobierno lo arrestó y detuvo de manera ilegal.
El juez concluyó que ICE aplicó incorrectamente la ley federal de inmigración, violó el debido proceso y mantuvo a nuestro cliente sin orden judicial, sin cargos y sin autoridad legal. El tribunal dejó claro que las personas que ya viven en Estados Unidos no pueden ser detenidas automáticamente sin audiencias.
El gobierno fue prohibido permanentemente de continuar con esta práctica ilegal, y los fiscales federales fueron ordenados a explicar por qué no deben ser sancionados.
