🚨 Major Proposed Change to OPT

DHS has proposed significant new fees for F-1 students seeking OPT:

🔹 $70,000 for initial OPT
🔹 $30,000 for subsequent OPT

⚠️ This is only a proposed rule — it is NOT currently in effect.

The public comment period runs from October 8–November 9, 2026. Follow Paturi Law for updates as this proposal develops.

📢 Is your H-1B Cap COS Still Pending After October 1st 2026? Know Your Cap-Gap Rules.

Eligible F-1 students with a pending cap-subject H-1B change-of-status petition may have Cap-Gap employment authorization through April 1, 2027, or until USCIS makes a decision, whichever comes first.

⚠️ Remember: Permission to stay in the U.S. and permission to work are not the same thing.
Check with your DSO and confirm that your SEVIS record correctly reflects your Cap-Gap extension.

⚠️ Filing Form I-485? Know how the public-charge review may affect your case.

As of September 18, 2026, USCIS applies a broader public-charge review. Officers may consider an applicant’s age, health, income, assets, financial obligations, education, job skills, and receipt of certain public benefits in the past.

The determination is based on the applicant’s overall circumstances and may affect family-based and certain employment-based green card applicants. Some humanitarian categories are exempt.

Before filing, carefully review your financial and public-benefit history and make sure your application includes complete and accurate supporting evidence.

CPT must be directly related to your major, be an integral part of your school’s established curriculum, and be properly authorized by your DSO.
Once approved, carefully check the employer, work location, permitted hours, and exact start and end dates listed on your Form I-20. CPT does not automatically continue into the next semester.
If you need an extension, contact your DSO before the authorization expires and obtain an updated Form I-20 before continuing to work. Working outside the authorized terms even for one day may place your F-1 status and SEVIS record at risk.

🚨 Important Duration of Status Update

The DHS rule replacing Duration of Status, or D/S, with fixed admission periods for F-1 students, J-1 exchange visitors, and foreign media representatives was scheduled to take effect on September 15, 2026.

However, a federal court has postponed the rule’s effective date and temporarily stopped DHS and ICE from implementing it while the case continues.

This means the scheduled September 15 change will not take effect, and the current D/S system remains in place for now.

Please remember: the rule has not been permanently canceled. Continue monitoring official updates as the court case proceeds.

DHS has proposed eliminating the up to 60-day grace period available to certain employment-based nonimmigrant workers after their employment ends. *This is only a proposed rule* at this time. The current grace-period regulation remains in effect unless and until a final rule changes it.

Stay informed as this proposal moves through the rulemaking process.
