Know your rights, you have a right to refuse consent to any searches of your vehicle. But do so calmly and politely. Also, it would be in your best interest to keep track of how much time is takes for the officer to complete the traffic stop. Make a note of:

1. When the stop is initiated
2. When the officer tells you the reason why you were pulled over.
3. If the officer ask for consent to search your vehicle, when the officer ask for permission.
4. If the officer calls in a K-9 unit (drug sniffing dog) make note of when the unit arrives.
5. If you are asked to step out of the vehicle for any reason or feel that you are not free to leave than also make a note.
6. Finally if you are not free to leave or arrested, ask to speak with your attorney immediately.

This simple steps could be the difference between preserving your constitutional rights and potentially the difference between an arrest and an conviction.

I'm sure this is a controversial practice but as someone who's defended the accused for my entire legal career I can see the validity in this concept. I have clients who are facing years in prison for first time minor drug offenses due to archaic drug sentencing laws. I genuinely feel for my clients and feel they may have made mistakes in life but are certainly capable of being productive members of society, many of them were and are already. If the purpose of sentencing is rehabilitation and reform than we need to seriously look at why our sentencing is so heavily swayed towards pure punishment. Is the criminal justice system intended to create better citizens, neighbors and people or better criminals?

Happy Independence Day Weekend!!! Let's all take time to celebrate our great nation for the all the things that makes us all Americans and forget for a moment the things that we may differ on. After all, one the greatest freedoms we all share is the freedom to think freely and differently from others.

Also, be safe out there this weekend. It's a busy time for BBQ's, fireworks and celebrations, but also a busy time for law enforcement. If you are contacted by law enforcement you may politely ask if you are free to leave. If you are not free to leave you may always exercise your right to remain silent and to consult with an attorney.

Big changes are on the horizon for 2013 as Florida's Auto Insurance Personal Injury Protection (PIP) laws change in the new year. Starting tomorrow, you will now be required to seek medical attention within 14 days of the accident or risk losing your PIP benefits entirely. Also, you must be seen by medical doctor to assess that you have an emergency medical condition in order to attain your full $10,000.00 in PIP benefits, otherwise you will be limited to $2,500.00.
