"He got the ticket, so we're covered" is something I hear right after almost every crash, before anyone's even called a lawyer.
That ticket, and the report the officer filed, generally can't be used in a Florida civil trial to prove who caused the crash. The insurance company knows that too. So even with a citation in the other driver's hand, they can still argue you share some of the blame.
That argument has teeth. Since March 24, 2023, Florida law cuts your damages by whatever percentage of fault you're assigned, and if you're found more than half responsible, you recover nothing at all. A citation helps. It doesn't end the fight.
