💭 Question of the Week: Can you inherit someone’s debt when they die?

Usually, no.

In Florida, you generally don’t become personally responsible for someone’s debt simply because you’re their child, spouse or beneficiary.

So what does happen?

When someone dies, valid debts are generally handled through their estate before the remaining assets are distributed to beneficiaries. If there isn’t enough in the estate to pay everything, that doesn’t automatically mean the family has to pick up the bill.

There are exceptions, especially if you were already legally responsible for the debt, such as through a jointly held or co-signed obligation. Secured debts, like a mortgage, can also affect the property tied to them.

The takeaway? Inheriting from someone and inheriting their personal debt are not the same thing.

Estate and probate situations can get complicated quickly, so if you’re dealing with a loved one’s estate or creditor claims, The Orlando Law Group can help you understand what you are and aren’t responsible for. Call 407-565-HELP

The sudden closure of Gringos Locos left dozens of Central Florida employees without work and still waiting for their full final pay.

Jen spoke with Spectrum News 13 about the resources and next steps available to workers facing an already difficult situation.
