⚠️ Important update for asylum applicants · April 28, 2026

Under H.R. 1, there is now a required Annual Asylum Fee of $100 that must be paid each year your Form I-589 asylum case is still pending with USCIS.

➑️ If you receive a notice from USCIS, you have 30 days to pay.
➑️ If you do not pay on time, USCIS will close your pending asylum case.
➑️ If your work permit was based on your pending asylum case, it will also be cancelled.
➑️ If you do not have legal status in the U.S., removal proceedings may begin.

This rule is effective May 29, 2026. This fee cannot be waived.

Did you know that having a pending work permit does not mean you can start working right away?

➑️ The I-765 is the form you file with USCIS to request permission to work legally in the United States. Once approved, you receive your Employment Authorization Document, commonly known as a work permit or EAD.

➑️ An EAD and a work visa are not the same thing. Your EAD is tied to your immigration status and must be renewed before it expires.
