Disability Insurance Claims/Disputes
Pension Disputes
Employment Contract Disputes And, I never dabble in areas that I am not proficient in.

I am admitted to practice before all New York State courts, the federal court for the Western District of New York, the Second Circuit Court of Appeals, and the United States Court of Appeals for the Federal Circuit. I received my law degree from UB Law, where I earned special recognition for my appellate advocacy skills, and my bachelor of arts degree, magna cm laude, from SUNY College at Buffal

o, where I earned special honors for excellence in philosophy. Most of my work involves ERISA (Employee Retirement Income Security Act), which is a federal statute that governs employee benefits like pensions, disability insurance, and retiree health insurance. I also regularly handle contract issues, such as non-compete and severance agreements and negotiations, and I maintain a healthy pro bono and reduced rate practice for those unable to afford legal counsel - including no-cost preparation of a will, power of attorney, and health care proxy for any person without such legal documents who has been diagnosed with cancer or other terminal illness. [As someone living with metastatic breast cancer, this is an issue particularly close to my heart.]

I never sign a case that I don't believe in. I never accept compensation from someone unless I think their claims have merit. I practice law, just as I try to live my life, with integrity, candor, skill, and honesty.

Postage for overnighting a thousand pages of evidence in support of my client's claim for long-term disability benefits: $52

Getting to call that same client one week before Christmas to tell him that we won his appeal and he will be receiving nearly $400k in back and future benefits: Priceless.

Did you know that some group life insurance (and disability insurance) policies provide that if you become disabled your premiums for the insurance will be waived for all times that you remain disabled? [If you have group coverage through your employer, be sure you know what you're entitled to in the event of disability.]

*

Today, I won a life insurance waiver of premium (LWOP) appeal for a client who has been disabled for nearly 20 years. His life insurance was terminated last year when the insurance company abruptly determined, without any change in my client's medical conditions, that he was no longer disabled. On appeal, this decision was reversed, he was found to be permanently totally disabled, and his half a million dollars in life insurance coverage was reinstated and will continue to be in place at no cost to him through the life of the policy. This is an incredible victory inasmuch as the cost of purchasing replacement coverage at that level would be unfeasible for him.

*

These claims are also tricky because unless an attorney is willing to keep the project cost-effective for the client (despite the extensive amount of legal work required), many clients will simply be unable to afford legal counsel to assist them in their appeal, which, in my experience, almost always results in the claimant losing the appeal.

*

I don't take these claims (or any claims, for that matter) to line my pockets. I take them because I firmly believe in being of service. And, if I'm being honest, because I despise corporate greed, especially when it's at the expense of some of the most vulnerable in our society.

*

Cheers to another victory in the books for the little guys of the world!

My story.

As a lawyer, I cannot promise or guarantee success in any legal endeavor. But, what I can promise is that I will do my absolute best to find a winning argument for you. And, I will feverishly advocate for you. I can also promise you that I will be honest about your case; about my opinion on your chances of success, the value of your damages or claims, and whether it makes sense for you to pay me, or anyone, to pursue them. I'm not out to take anyone to the bank, or to make a buck. I want to practice law differently.

I believe that having a career should complement my personal life, not rule it. I believe that everyone with a meritorious claim should have access to cost-effective and competent legal advocates. I believe that a high quality of life breeds success in all endeavors. I believe that I can learn just as much from my clients as they can from me.

Most of my practice is devoted to ERISA and labor and employment issues. I'm good at it, the law geek in me loves this work, and, at the end of the day, I like fighting the good fight for the little guy.

I am admitted to practice before all New York State courts (2004), the federal court for the Western District of New York (2005), the Second Circuit Court of Appeals (2005), and the United States Court of Appeals for the Federal Circuit (2014). I received my law degree from UB Law (2003), where I earned special recognition for my appellate advocacy skills, and my bachelor of arts degree, magna cm laude, from SUNY College at Buffalo (2000), where I earned special honors for excellence in philosophy. When I am not seeking justice, you might find me indulging on oysters and wine at any number of local restaurants, or walking about town with my boys hunting for zombies.
