The trademarking process can seem like an impossible task. When we break it down into steps, it can be easier to digest. Here are some things you need to do:

1. Perform a Search: Check out the Trademark Electronic Search System (TESS) and perform a basic word search of your mark and its variations to confirm the availability of your mark.
2. Gather Evidence: This is your specimen to prove that you use your mark in commerce. The specimen should directly correlate your mark and your product/service.
3. File your Application: Follow the directions carefully and fill out each question. If you have any questions, the Trademark Office has a guide that can help you answer the questions as best as you can.
4. Attorney Review: Once your application is filed, it will take a couple of months for an attorney with the trademark office to review your mark, do a search, and either publish your mark for opposition or submit an office action for you to respond to.
5. Registration: Your mark is registered once you respond to the office action or defeat any opposition. If your mark is still denied, the trademark office will explain why (this will be the final office action).
