Finally, after more than 45 years, the amount of compensation available to victims of medical malpractice for their pain and suffering has been increased. Since 1976, California's Medical Injury Compensation Reform Act (MICRA) has limited pain and suffering damages to $250,000.00. Beginning on January 1, 2023, that figure is being increased to $350,000.00, and it will increase every year thereafter until the limit reaches $750,000.00. For malpractice claims resulting in death, the survivors will be able to recover up to $500,000.00 next year for their noneconomic damages, and that figure will increase every year until it reaches the $1,000,000.00 mark. While seemingly unfair that there is any limit at all, this change in the law at least gets malpractice victims closer to a fair result.
