It is incorrect to believe that deportation is the end of the line for those who are dreaming of a better life within the United States of America. When faced with charges that can lead to removal from the States there are several options that can be taken to avoid being deported.

🔹Motions to terminate removal proceedings,
🔹Motions to suppress evidence,
🔹Requests for prosecutorial discretion,
🔹Motions to administratively close removal proceedings.

The above are all defenses that can be discussed with a trusted lawyer and applied to an individuals case.

It is possible that there were ways an individual violated the law and those circumstances could make that person deportable. However, in many cases he/she may be eligible to file an application for relief from removal with the Immigration Judge.

Discuss with your lawyer if these are circumstances that apply to you and which application would best fit in your case. Each application has different legal requirements, making it important to discuss with an experienced legal professional.

After the DHS files the NTS with the immigration court, the foreign national will be scheduled for an initial hearing. This hearing will be with a specialized immigration judge.

At this first hearing the foreign national will be told their rights, especially as the relate to removal proceedings. These rights also include the right to represented by an attorney, which is highly encouraged.

After this initial hearing others will follow, as the judge reviews the case. In the first or second master hearing, the foreign national will be asked to admit or deny the factual allegations and charges contained in the NTA.

If the IJ determines that the charges in the NTA are true, the IJ will

-Ask if the foreign national will be applying for any defenses or relief from removal.

-Set a deadline for any applications to be filed with the Immigration Court.

The foreign national will:

-Be given an instruction sheet on where and how to file his/her applications (with any applicable filing fee).

-Be advised of his/her responsibility to comply with all fingerprint appointments in connection with the applications.

IMPORTANT:
IF the foreign national does not speak English, the immigration court will provide an interpreter.

In these situations, it is important to know your rights and understand them. Pay attention to the proceedings to make sure they do not violate your rights.

Deportation is also referred to as removal proceedings, and they are an administrative court process. These cases are handled by a Department of Justice Immigration Judge.

The process of possible deportation starts with a Notice to Appear (NTA) being served in person or by mail.

In this document are factual allegations and charges that the DHS believes supports the claim that the individual should be deported from the United States. These reasons include things like: entering the United States without inspection, overstaying a visa, violating visa, was convicted of certain crimes, and others.

It is important to remember that in these cases the Immigration National Act can be unforgiving when it comes to immigration consequences of certain criminal convictions.

Having an experienced legal professional on such cases as these can be extremely useful.

Some quick myth busting this Wednesday.

Several people believe that having a green card means that you are considered an American citizen.

While a green card is amazing and opens up so many doors. However it is just a part of the process of becoming an American citizen, it is not naturalization in its entirety. A green card allows the holder to be a lawful permanent resident and work freely within the states.

However, a citizen holds several additional rights that green card does not cover. Such as, the right to vote and sponsor family members in their journey to the states.

If you hold a green card make sure you are aware of the freedoms it gives you.

A Green Card. We hear about it a lot, but what actually is it?

Well to explain simply it is an official card given by the government to immigrants that represents their ability to live and work in the United States of America permanently. It is officially known as a permanent residence card.

The reason this card is so important is because of the doors it opens up for those who possess it. Not only can those individuals travel inside and outside of the country, they can also hold jobs or switch occupations within the United States without fear of violating their visas.

The green card is fundamentally important in the process of becoming a citizen of the United States of America.

Harry S. Truman was right when he said "America was not built on fear. America was built on courage, on imagination, and an unbeatable determination to do the job at hand."

Since the beginning of this great country we have been a place of growth, change, and new starts. Our country was built by the hands of hard workers from all over the world. It was built to stand as a beacon of hope to all those around.

What is the end goal of immigration?

When we were asked this question we had to ponder for a while on the best reply to give.

Soon we realized everyone will have different answers for this particular question, the same way that every persons immigration journey is different.

Some people need visa work done so they can work in the states for a set period of time. Some people hope to bring their families over. Others need protection. And there are several students who come to pursue their studies.

And there are many people who have the goal of becoming a citizen of the United States of America. Being a citizen would mean that a person is free to travel, live, work, and thrive in the United States. Protected by the laws of the land. Able to vote. Able to participate in life as an American Citizen. Able to represent the red, white, and blue that has made us such a powerful and strong nation in the first place.

Being a citizen of the United States is an honor, and something that we here at Jason Finch & Associates understand is very important. It is something we do not take lightly. It is something we are proud to represent and stand for.

We also know that it is not a quick, one size fits all sort of process. There are often road blocks and frustrations along the path of citizenship.

However, we have seen some of the most incredible, believing people come through our doors. They place their trust in us, and it is our duty as well as responsibility to do all we can for them.

Now we finish our posts about employment based immigrant visas with the EB-5 visa. A very interesting visa for several reasons!

🔹This visa is for people who invest money in the U.S. and help create jobs for American workers.
🔹You must invest in a new business.
🔹The required investment is typically $500,000 or $1 million, depending on the situation. The money invested must actually be at risk in the business. It cannot sit in an account or have a guarantee of return.
🔹Investment must lead to job creation for U.S. workers. Creating more than just a handful of jobs for the American people.

It is important to note that with this visa, as well as most others, the processing time can take a long time. It depends on demand as well as country of origin. However, if you are interested in taking this route to citizenship in the United States of America, then apply.
