A great property for sale. DDB is the attorney for one of the heirs and, after filing a lawsuit, I was able to compel this sale and have the net proceeds divided per the revocable trust of the heir's father. It turned out to be a difficult case, but very rewarding in the end.

That has not been my experience. And even if it was, I'd never write that in a public forum in order to attract clients.

I need to explain exactly what happened. I had in my file an original signed and notarized Verified Petition. It was signed and notarized before it was filed. There is a Nebraska Supreme Court rule that says all pleadings must be filed electronically and as a PDF. So, instead of scanning the signed in blue ink and notarized version, I filed a PDF with conformed signatures. I also filed on JUSTICE my certificate under Nebr. Ct. Rule 2-207 that I had the signed original in my file the entire time and that I mailed it to the Clerk of the District Court. At the hearing, I also argued that the Nebraska Uniform Electronic Transactions Act made the signatures good. These facts didn't make it into the Judge's decision. That's okay as he did deal with the merits of the case under my declaratory judgment act cause of action.

The Judge disagreed with our view of Nebraska election law regarding recounts. It was a complicated question of statutory interpretation. His word is final and I fully respect that. He did act promptly, and I appreciate that.

"Begley cited a section of state law concerning legislative recounts. The section does not specify the method to be used for those recounts, which he argued meant they are to be done as they were in ancient Greece or in Nebraska up until 1975."

A Lincoln legislative candidate lost his bid to have a hand recount of ballots in his race after a judge tossed his lawsuit for technical and legal reasons.

I thank the judge for promptly ruling on this case. It was a complicated question of law.
