"I already had back problems before the accident. Do I still have a case?"
This is one of the most common questions we hear after a car accident.
Many people assume that because they had a prior injury, arthritis, neck pain, back pain, or another medical condition before the crash, they cannot recover compensation. Fortunately, that's often not true.
Under Nebraska law, an at-fault driver may still be responsible if an accident caused a new injury or worsened a pre-existing condition.
In fact, many injury victims aren't in perfect health before an accident occurs. The important question is whether the crash made the condition worse, increased pain, required additional treatment, or affected daily life in a new way.
Unfortunately, insurance companies often try to use pre-existing conditions as a reason to minimize or deny injury claims. That's why proper medical documentation and understanding your legal rights are so important.
If you've been injured in a Nebraska car accident and have questions about how a prior injury may affect your claim, we're happy to help.
