The Department of Homeland Security has proposed a new $103,265 fee for certain H-1B cap-subject petitions.

This proposed fee is separate from the $100,000 proclamation fee announced last year and would apply to initial cap-subject petitions. Cap-exempt petitions, extensions, amendments, and transfers for beneficiaries already counted against the cap would not be subject to the new fee.

Public comments on the proposed rule are due by September 24, 2026.
