The Internal Revenue Code grants spouses several tax benefits both during life and at death. Portability represents one of those benefits. Portability allows the surviving spouse to use the unused portion of the Applicable Exclusion Amount from their predeceased spouse. In Revenue Procedure 2022-32, the Internal Revenue Service extended the time during which a surviving spouse may elect portability without a Private Letter Ruling from two years to five years.

To determine a decedent’s taxable estate, the Internal Revenue Code allows the decedent’s estate to utilize several deductions in various Code Sections, including Section 2053. The Treasury Regulations associated with Section 2053 were favorable to the taxpayer and contained broad language regarding the deductibility of claims and expenses. Recently, the Internal Revenue Service promulgated Proposed Treasury Regulations that would narrow the benefit of taking certain deductions to an estate.

When clients undertake Estate Planning, they face the difficult decision of naming one or more individuals to serve in various fiduciary positions. If a client sets up an irrevocable trust during life, the client may prefer to serve as trustee instead of naming a third party. Serving as trustee gives comfort to the trustor that they maintain a level of control over the assets transferred to the irrevocable trust; however, depending upon the provisions of the trust, naming a trustor as trustee of an irrevocable trust could defeat the intended tax consequences. It's a great day to be at the "2nd Annual Conference: Navigating the Challenges of Aging" for faith-based leaders serving older adults and seniors in Oklahoma. We've heard excellent presentations by our friends from the Alzheimer's Association Oklahoma Chapter and Parman & Easterday
My children's, (Brian J. Reed and DeAnna M. Reed) grandfather, Forrest E. Reed, passed away in 2014. We believe he used your firm to make his will. Brian and DeAnna would like a copy of their grandfather's will, can you help us? Thanks so much.
My husband, Peyton, died of cancer two years ago. He prepared for his death in every way possible from having total maintenance done on every item in our home to writing a book for me called “After Peyton” with lists of who to call for every eventuality and the appropriate sequence. His preparation made the difference in my survival.
I learned through my experience that our society is sadly ignorant of death. We hide from it. We ignore it. We fear it and we fear those who are touched by it. Every instance is termed a shock, yet it is the one constant in our lives after birth. I want to help change that. My goal is to change public knowledge, attitudes and behavior towards dying, death and bereavement through open communications and shared experience. I plan for this to be a repository for information and an open forum for discussion.
