Last week, I had the opportunity to meet with the author of "Shielded," a powerful exploration of the pervasive protections that law enforcement enjoys—legal, financial, and criminal—regardless of whether their actions violate constitutional rights. It's crucial to understand that when individuals are insulated from the repercussions of their misconduct, they are more likely to engage in and repeat those unconstitutional behaviors.
The recent Executive Order from the Trump Administration exacerbates this troubling trend, offering increased legal backing, more lethal weaponry, and stronger incentives to cover up their unconstitutional actions through misleading accusations against their victims. In the realm of civil rights, we recognize these frequently used false charges as "The Big 3": assault and battery on an officer, resisting arrest, and obstruction.
We must confront the very real fear that this Executive Order could pave the way for martial law, particularly if this Administration embarks on a sweeping assault on our rights, reminiscent of the shocking events of January 6th or the violent actions taken at Lafayette Park. In these crises, police may act with impunity, believing they will face no consequences for their unconstitutional behavior.
If we allow this situation to unfold, it will not solely be the fault of this Administration or the Executive Order—it will be a reflection of a broader failure to hold law enforcement accountable in courtrooms nationwide.
