Finished a 46 page brief yesterday and got rewarded with a date night with my wife to watch the one and only Luke Combs. Work hard to play hard!
ThunderUp! Always good watching the Thunder play against Oklahoma players especially Trae Young (former Norman North product). That said, I got the Thunder tonight!!!!

We filed the suit and after hard and creative work we discovered the defendant had not been telling the truth. In the end, the defendant’s insurance company offered their policy limits leaving a very happy client. Remember, ordinary lawyers get ordinary results. Extraordinary lawyers get extraordinary results.
A violinist played for 45 minutes in the New York subway. A handful of people stopped, a couple clapped, and the violinist raised about $30 in tips.
No one knew this, but the violinist was Joshua Bell, one of the best musicians in the world. In that subway, Joshua played one of the most intricate pieces ever written with a violin worth 3.5 million dollars.
Two days before he played in the subway, Joshua Bell sold out a Boston theatre, and the seats averaged about $100.
The experiment proved that the extraordinary in an ordinary environment does not shine and is so often overlooked and undervalued.
There are brilliantly talented people everywhere who aren’t receiving the recognition and reward they deserve. But once they arm themselves with value and confidence and remove themselves from an environment that isn’t serving them, they thrive and grow.
Your gut is telling you something. Listen to it if it’s telling you where you are isn’t enough!

Oklahoma is often portrayed as being a flat prairie. That’s not the case especially in the eastern part of the state. Unfortunately, we see way too many Oklahomans injured on dirt backroads due to the negligence of another. Remember, stay on your side of the road, slow down if you can’t see and take your time. In the mountains this morning with my little man (11 year old), father and family members for our annual hunting excursion. I’ve been doing this for the majority of my almost 47 years of life. My father claims he has been doing this for over 70 years as we are still on the land he tries to convince us he walked barefooted as a kid 😂.
So happy to get to share this with Skyler and teach the next generation responsible land and animal conservation. Best part is we are about to hike back to the cabin for breakfast and a little worship.

I am a 3rd generation Oklahoman who is blessed to get to spend a weekend with a 4th generation Thurman admiring God’s beauty in nature this cold Saturday morning. At McIntyre Law we are real animal lovers. My three dogs pictured are Rumble (7 year old Yorkie and yes think of the OKC Thunder), Dallas aka Dally (4.5 year old Boston Terrier who, if you zoom super close, has a small snake in his collar) and last but not least Ellie Mae (2 year old spoiled rotten Frenchie in the tutu). One of the great things about dogs is no matter how good or bad your day is they are always happy to see you when you walk through the door. Take care of your pets and love them as much as they love you.

Who said being a lawyer isn’t filled with daily danger. Almost stepped on this harmless snake coming out of the office for lunch. Needless to say I finally improved on my 1 inch old man vertical leap. Once I gathered myself I saw he was harmless and let him or her go on their way!

DON’T BE FOOLED BY AN ADJUSTER OR LAWYER CLAIMING YOU DON’T HAVE A CAR WRECK CASE DURING AN ICE STORM! ITS FAKE NEWS!
Guess what central and western Oklahoma? Its sleeting and icing. I can hear the pings of ice against my window. As this early season storm hits, I hope everyone stays safe. However, I know there are going to be some car crashes and that motorists will be hurt. I also know that insurance companies will ramp up their fake news campaign by refusing to pay hurt motorists’ damages for crashes that occur during an ice storm. They will claim that the ice caused the crash, and it was unavoidable. This is fake news!
If the roads are slick the law on negligence does not change. The person who runs the stop sign, who fails to stop at the red light or who loses control and causes a crash is still at fault. So, what is negligence? Negligence is simply not behaving like a reasonably careful person would under similar conditions. In the case of a stop sign, a reasonably safe driver will stop and not proceed through until it is safe to do so. This driving rule does not change because ice is on the road. You still must stop. If you slide through the stop sign you are still at fault.
So why am I even writing this? I have seen throughout the years insurance companies tell injured Oklahomans that they are not going to pay for their automobile or their injuries because ice was on the roadway. They will try to get you to settle for pennies on the dollar and/or deny your claim in full hoping you will not find an experienced personal injury attorney.
So how do you overcome the unavoidable collision defense? Oklahoma law is dirt simple. If a defendant is going to claim the collision was unavoidable because of slippery conditions they MUST show that the collision was unforeseeable. That means that no one could have foreseen that the roads would be slick. The Oklahoma Supreme Court says that the unavoidable collision defense “should be restricted to those instances where the evidence indicates the occurrence was caused by unforeseen circumstances or conditions…it depends on an introduction of evidence showing some factor over which the parties had no control, or could not, except by exceptional foresight, have predicted.” What the Oklahoma law is saying is that ice and snow are not a real unavoidable accident defense to your claim. Everyone has access to the weather channel. Everyone has access to radio. We have our own eyes and our own common sense to see if it’s snowing, icing, or sleeting. Every meteorologist will tell you to stay at home during these times as the roadways can be treacherous. Therefore, its common sense that a wreck on ice is foreseeable and the driver has control of whether he or she can safely be on the road. So, all you have to show to overcome this defense is the negligent driver knew or should have known that the roadways were slick. If you can demonstrate that you will likely win.
So, if an adjuster or lawyer tells you that everyone is responsible for their own damages in a crash on ice then ignore them. Hire a qualified attorney whose practice focuses on personal injury. For about 12 years I've taken a special interest in trucking cases. A couple of years ago we had the opportunity represent a family in this tragic case that resulted in one of the largest truck collision verdicts Tulsa has had. One of the interesting facts about the case is that the Defendant denied being at fault. We were able to show not only that they were at fault but this crash could have been prevented had they followed simple Federal Motor Carrier Regulations.
