secured a win in Tulsa on the mouthpiece issue which can impact all breath tests in the State.
DPS is obviously appealing and if the supreme Court upholds our position – It will invalidate Every Breath test in the State.

Here is what DPS has explained this morning. If you have a client who reinstated and is currently on the Erin Swezey interlock requirement whether they did it before or after November 1, 2019 they can call DPS and ask to speak with a driver compliance hearing officer and ask that the interlock restriction be removed from their driving record.

Once DPS removes the restriction they can either keep the license they have or go to a tag agency to have a new license made which will not have the restriction for an interlock device. Note: They will have to pay for the new license. If your client is licensed in another state, then they will just keep their own state's license.

If you have a client who never reinstated they will need to go see a hearing officer ask to have the restriction removed and pay their reinstatement fee and provide a copy of their drug and alcohol assessment completion certificate.

I would recommend advising your clients that DPS will probably be swamped and it may take them awhile to speak with a hearing officer as I would imagine a number of people will be calling or going in to see them.

We have concluded the work with DPS and the restrictions under the Erin Swezey Act are no longer valid...
This applies to people waiting to reinstate as well as those currently serving the extra restriction periods of 18 months, 4 years and 5 years. It does not apply to an initial revocation period

Dramatic changes were made to Oklahoma laws regarding Drivers Licenses after a DUI on November 1, 2019. Brian Morton provides exclusive representation for clients of Hunsucker Legal Group in OKC and Edge Law Firm in Tulsa. He and each of the firms offer assistance to many attorneys dealing with these issues. We wanted to improve and streamline communications statewide. Thus, we created this page-- Oklahoma Driver's License Attorney.

We have uploaded a video with a basic explanation of the options under the new law as well as some of the procedures. Our plan is to add more videos as we receive questions and possibly even do interactive face-time live videos. We will not be announcing each video as it is posted so it is important to ‘like’ the page to receive notification.
