People often assume that “trusts” are only for families that have mass amounts of generational wealth. This is just not the case. Trusts can avoid probate, account for complex distribution wishes/desires, and typically cost less than the average probate in Oklahoma. Contact us if you think a trust might benefit your family.

Estate Planning Tip No.: 4

You are the only person who can make sure YOUR wishes are carried out. I routinely litigate family estate issues because “mom and dad thought so-and-so would do the right thing!” Never trust the living!

Estate Planning tip No.: 3

Trusts are not only for people with a large amount of assets. Some people think of the terms “trust fund” or “trust fund baby” and automatically assume that a trust is not a good option for them. A trust is a factitious entity created to distribute your assets exactly how you choose to and to keep them out of probate. If you own a home or a business, you are likely a good candidate for a trust.

Estate Planning tip No.: 2

Make sure all life insurance policies list a beneficiary and a contingency beneficiary, and keep your beneficiaries updated. You do not want your life insurance to default to your estate. You will then need a probate, and creditors will be able to attach to those monies.

Life insurance should avoid creditors. Call Goodnight Law at 405-871-5981.

Estate Planning tip No.: 1

In Oklahoma, a Last Will and Testament will not transfer assets and property to you or your loved ones automatically. You will need a probate, which is a long and expensive court proceeding ($5k-$10k). You do NOT want to go through probate.

You and your loved ones need an estate plan. Call Goodnight Law at 405-871-5981.
