If your family member was detained by ICE and told there's no bond hearing available, that information may now be outdated. Federal appeals courts have ruled that the government's mandatory detention policy was illegal, at least in several circuits. In June, July, and August 2026, the Tenth, Ninth, and Third Circuit Courts overturned the government's shift to locking up longtime U.S. residents without bond hearings, even when they have family, employment, and community roots.
The ruling directly applies to detainees in Utah, Colorado, Washington, Pennsylvania, and other specific regions. Time is critical: if your family member is still detained without a hearing, you need to act now. The location where they're detained determines whether these new rulings apply to their case.
