On Friday, California Insurance Commissioner Ricardo Lara issued his decision on the advisory workers' compensation rate. His recommendation is to maintain the existing benchmark rate of $1.45 per $100 of payroll. The $1.45 average rate is less than the $1.56 rate that was proposed by the Workers' Compensation Insurance Rating Bureau. The Supreme Court declined to hear an appeal from the California Trucking Association related to employee classification of owner-operators. The association claimed that AB-5, the 2019 law that overhauled how California employees are classified, was preempted by Federal law — and thus doesn't apply to the trucking industry. The California Workers' Compensation Institute (CWCI) just released their study of costs under the California Medical-Legal Fee Schedule (MLFS). The schedule was revised in 2021; while costs were expected to rise, the CWCI study revealed that cost increases were much higher than anticipated.
