What is Estate Planning?

This page is meant to keep friends and family updated about my practice, and to post news and articles about estate planning. If you're looking for more information about my practice, please visit my website. An estate plan might include:
* wills
* trusts
* powers of attorney
* health care directives
* joint ownership of assets
* updating beneficiary designations on life insurance, retirement acc

ounts, or other property

Some of the most important reasons to do estate planning:
* Nominate guardians for your minor children
* Manage assets for your children when they are minors or young adults
* Avoid guardianship or conservatorship proceedings
* Minimize taxes
* Plan ahead for transfers of closely-held businesses
* Make sure your assets will pass according to your wishes, which is especially important for "non-traditional" families (second marriages, unmarried partners, blended families), and for people who want to leave money to charities or other non-family beneficiaries.

Are you thinking about doing estate planning (wills, trusts, etc.), but not sure what that looks like right now?

Hable Law has always offered most of our services virtually. This is our step-by-step process:

1. Our intake process can be done online. Contact Andrea to ask questions or to get started: https://hablelaw.com/contact/ We will send you an online intake form to help you gather information before meeting.

2. Planning meeting: In normal times, most clients have opted to meet in person for this meeting, but we’ve always welcomed video meetings. This is a comprehensive discussion with Andrea to talk about all of your choices about your estate planning. People often assume that estate planning is just writing down things like who you want to be the guardian for your kids, but it’s really so much more than that, such as talking through how assets transfer at death or how to delay inheritance for minors or young adults. The documents are just tools to accomplish your goals, so in this meeting we will talk about your big picture goals for estate planning.

3. Write your wishes for end-of-life care for your Health Care Directive. We have an online form that helps you work through this. This is optional and some clients skip this step.

4. Drafts are sent for you to review by email.

5. Email with Andrea to finalize your documents. Phone and video meetings are also available.

6. Signing meeting: This is the only step in the whole process that cannot be done entirely remotely. For the foreseeable future, we will do a pre-signing review meeting by video, and then a short “curbside” signing outside at our office to make sure documents are properly executed. In some cases we may mail documents to you for signing, but since most estate plans need two witnesses and a notary, when possible it makes more sense for us to help ensure this is all done properly.

Another year, another annual Probate & Trust Law Section Conference! 2 days of continuing education and catching up with colleagues. Totally enjoyed having the iPad for notes this year too, easier to carry and less to scan post-conference. @ Saint Paul RiverCentre

I can’t believe it’s the last day of school and summer is here! Enjoyed working outside this morning for a bit with the flowers. Looking forward to the next few days with my kiddos before transitioning to our summer routine. Wishing everyone a great end of the school year and a fun or relaxing summer!

Rethinking how we’ve learned in our culture to handle grief and loss is a subject I’ve grown to feel very strongly about. What’s really interesting about this article is the distinction between “shift response” and “support response,” even beyond the context of grief:

“ ‘The profusion of popular literature about listening and the etiquette of managing those who talk constantly about themselves suggests its pervasiveness in everyday life.’ Derber describes two kinds of responses in conversations: a shift response and a support response. The first shifts attention back to yourself, and the second supports the other person’s comment. Here is a simple illustration:

Shift Response
Mary: I’m so busy right now.
Tim: Me too. I’m totally overwhelmed.

Support Response
Mary: I’m so busy right now.
Tim: Why? What do you have to get done?

Here’s another example:

Shift Response
Karen: I need new shoes.
Mark: Me too. These things are falling apart.

Support Response
Karen: I need new shoes.
Mark: Oh yeah? What kind are you thinking about?

Shift responses are a hallmark of conversational narcissism. They help you turn the focus constantly back to yourself. But a support response encourages the other person to continue their story. These days, I try to be more aware of my instinct to share stories and talk about myself. I try to ask questions that encourage the other person to continue. I’ve also made a conscious effort to listen more and talk less. “

It's hard to believe September is almost over! I hope everyone has adjusted into any new routines for the school year. This summer I decided to take some extra time off to be home with my kids as they are getting older and we are transitioning child care stages, as our caregiver from the past several years is moving on and my youngest is going into preschool. I've always walked the line between working and being a part-time stay-at-home mom, and this summer I got to dive in more on being home with my kids. I was also hoping the change of pace would give me some headspace to revisit my website my behind-the-scenes setup, and it did! I've been back to work since the beginning of September and I'm so excited to share with you all of the new updates. But for now, here's to embracing the change of seasons (of weather or life), and a photo of us from earlier this summer.
